I expected nothing and I’m still disappointed. In a world plagued by rising hardware prices, digital only video game releases, and mass layoffs, at least we can rely on Nintendo for a little reli-… Oh no. In the newest edition of the Nintendo vs. US tariffs saga, I present to you another challenger: Consumers.
In a subsequent class action lawsuit filed in April following Nintendo’s own lawsuit with the United States government regarding tariff-related rebates, their official stance is to deny any form of rebate to the consumers, baring Nintendo wins/settles with the government at all. Last year, Nintendo rose the price of their accessories and Switch 1 model due to the implementation of tariffs in the United States goods coming from outside the country.
Since then, despite the tariffs being outlawed, prices remained the same (A pair of Joycon 2s are $99.99!). With the potential return from the US government, this effectively means Nintendo can double-dip from their products sold.
Current Status of the Suit
The class action lawsuit is intended to provide an avenue for consumers to get back some of the money they paid for inflated prices. In Nintendo’s eyes, they made the difficult decision to raise their prices due to market conditions, but consumers consented and agreed to buying their products at those prices and without official legal complaints (pushback online doesn’t count). To quote, here’s their official statement:
“Nintendo or one of its retailers set a price for each product, and consumers decided whether that price was worth paying. Those who bought Nintendo’s products received exactly what they bargained and paid for: a console, game and/or accessory at a price to which both parties agreed.”
Is a Class Action Suit Feasible?
Large corporations are not immune to class action lawsuits, with Sony losing one in May 2026 over their use of the PlayStation storefront as a literal monopoly. No ruling have been made on the Nintendo vs. Consumers case yet, so time will tell with this suit goes. Check out our site for any updates regarding it!
